Research on Land Administration Issues

All developing countries recognize the importance of governance and the rule of law as one of the most important prerequisites for successful social and economic development. However, given the fact that the institutional mechanisms are specific to each individual country, and there is no single guideline for assessing the quality of land administration, the World Bank experts and its partners have developed a single tool for assessing the quality of land administration.

This study was conducted at the global level by Land Equity International (Australia). Four countries were selected to conduct the study and test the land administration quality assessment tool: Peru, Kyrgyzstan, Tanzania and Indonesia. The main selection criteria for these countries were the presence of different categories of land resources and forms of management, including formal and traditional forms of management.

Research and testing of the tool in Kyrgyzstan was carried out by experts from the Rural Development Fund. As part of testing the methodology, the following studies were carried out:

  • Expert analysis
As part of this direction, an expert analysis of the legislation and institutions involved in land management was carried out according to key criteria according to the guidelines for assessing the quality of land management. Meetings were held with representatives of organizations, ministries and institutions, the necessary statistical data were collected, reports of the relevant institutions. After that, an in-depth analysis of the materials received was carried out and the corresponding ratings were assigned to the assessed aspects.

  • Expert group
In order to collect data on the experience and direct perception of the reality of land and legal relations management and the functionality of the relevant institutions, various expert groups, as part of the discussion of the issues studied, assigned appropriate ratings based on the collected data and based on their personal experience. The participants in the expert meetings included: lawyers specializing in land law, representatives of institutions involved in land management, researchers, representatives of NGOs, representatives of local governments, representatives of the judicial and tax authorities, land users. In total, 5 expert meetings were held on the following topics:
- Legal regulations and their implementation
- Land use planning, management and taxation of land resources
- Management and disposal of state land
- Settlement of disputes
- Regulation on information on the management and use of land resources.

  • Field sampling
This study was necessary to obtain quantitative data in order to improve the efficiency of analysis on a number of important issues related to the management of land and legal relations. A field sample study was carried out in the Kichi-Kemin Autonomous District and in 5 largest cities of the country:
- Bishkek city
- Osh city
- Jalalabat city
- Karakol city
- Tokmok city

Household survey on the management of land and legal relations
This study was conducted to collect the information that is needed for a global study on land governance issues. The aim is to assess the level of awareness of actual and potential users in the registration of land rights.

The study was conducted on the territory of 3 separate administrative-territorial units belonging to different registration departments (LRO). The selection of settlements was carried out according to the type of settlement: village, suburb and city. Thus, the following settlements were selected
- Bishkek city;
- from Lebedinovka, Alamudun district, Chui region;
- from Luxembourg, Issyk-Ata region, Chui region.

In each settlement, from 30 to 50 respondents were interviewed.
